General Prosecutor’s Office of Mongolia (GPO) held a press conference on a recent illegal surveillance case yesterday. Prosecutor in charge of public relations and monitoring of GPO Byasman Ganburged informed “The Police Authority reported to the General Intelligence Agency (GIA) of privacy breach case on certain journalists by a certain official. After an investigation, the GIA opened a criminal case on the officials and submitted to the GPO. The case is currently under investigation of the prosecutor’s authority.” However, the GPO refused to give further details on the names of victims or suspects.

Domestic media outlets have reported that the Minister of Justice and Home Affairs Nyamdorj Tsend presumably ordered to spy on certain journalists according to an anonymous post on social media. Mr. Nyamdorj has denied the allegations and told the media that the claims of threatening and wiretapping a journalist along with his/ her family members, and shooting the media representative’s car tire are an organized political scandal. His answers peaked some attention because the information that went viral on social media never mentioned a tire but a vehicle. He disclosed a number of information regarding the surveillance scandal that was not public ahead of his statement. Also, the GPO spokeswoman did not deny when asked if the suspect was Nyamdorj.
The fact that Mr. Nyamdorj has been strongly criticizing matters of surveillance and wiretapping makes the matter of more importance if he is proven guilty. In the past, he was involved in several wiretapping and surveillance cases, all of which were settled without proper investigation in the past; for instance, surveillance on teachers in 1992-1996 when he was a member of parliament and surveillance on MPRP head Enkhbayar Nambar and former PM Jasrai Puntsag in 1997. Also back in 2003, former MP Gundalai Lamjav claimed Nyamdorj as Chinese spy. Former General Baatar Jaalkhuu, who was investigating him, once said “There are witnesses who saw Nyamdorj with a Chinese officials. Even a photograph exists to prove it. However, the court ignored these evidence.” Mr. Baatar was later imprisoned over a disclosure of state secret.
In addition, the Parliamentary Democratic Party’s group demanded the Prime Minister to dismiss Mr. Nyamdorj over certain violation of budget law and other issues earlier this week.
